The four concepts the individual has chosen are: negotiorium gestio, real obligation, fortuitous event and conditional obligation. One day, John was walking home from school when he found a wallet on the ground. He picked it up and saw that there was a lot of money inside. He knew that he should return the wallet to its owner, but he was tempted to keep the money for himself. After thinking about it for a while, John decided to return the wallet to its owner. This act of returning the wallet is an example of negotiorium gestio. Even though John returned the wallet, he still felt like he deserved some kind of reward for his honesty. So he went back to the owner’s house and asked for a reward. The owner thanked John for his honesty and gave him a hundred dollars as a reward. Now, John has a real obligation to spend the money wisely since it is not his own money. On his way home, John ran into his friend Tom. Tom asked John if he wanted to play video games at his house. John said yes and followed Tom home. When they got there, they started playing their game but then suddenly power went out because of fortuitous event or force majeure. They were both disappointed but John said that it was okay since he still had the money from before. Tom then asked John what he was talking about and John told him the whole story. Since the power went out, they couldn’t play video games anymore so they decided to go outside and play basketball instead. While they were playing, John sprained his ankle. Tom took John home and told his mom what happened. John’s mom thanked Tom for taking care of her son and promised to pay him back soon. This promise is an example of a conditional obligation since it is dependent on something happening (in this case, John getting better). Explanation: The notions of negotiorium gestio, actual obligation, fortuitous incident, and conditional obligation are the ones that the individual has decided to focus on. When John was going home from school one day, he came across a wallet that had fallen to the ground. When he picked it up, he discovered that it contained a significant amount of cash. Even though he knew he should give the wallet back to the person who lost it, he couldn’t resist the urge to retain the money for himself. After giving it some thought, John ultimately settled on giving the wallet back to the person who had lost it. The act of handing back the wallet is an illustration of the legal concept of negotiorium gestio. John believed that he should have been given some sort of prize for his honesty despite the fact that he had returned the wallet to its owner. After that, he went back to the house of the owner and demanded a recompense from him. John was rewarded one hundred dollars by the proprietor for his trustworthy behavior, to which he expressed his gratitude. Due to the fact that John is not spending his own money, he is under a serious obligation to do so in a responsible manner. John was surprised to see his old friend Tom while he was walking home. Tom spoke to John as to whether or not he would be interested in playing video games at his house. John responded with a nod and then followed Tom back home. As soon as they arrived, they immediately began playing their game, but just as they were getting into it, the power suddenly went out due to a fortunate event or force majeure. They were both dismayed, but John consoled them by explaining that it was not a problem for him because he had the money from previously. Tom then inquired as to what John was referring to, at which point John informed him of the entire event. They were unable to continue playing their video games once the power went out, so they made the decision to go outdoors and play some basketball instead. John suffered a sprained ankle as a result of the game they were playing. Tom brought John home, where he broke the news to John’s mother. John’s mother expressed her gratitude to Tom for taking care of her son and assured him that she will compensate him in the near future. Because its fulfillment is contingent on the occurrence of a certain event, this promise is an illustration of a conditional duty (in this case, John getting better).
