Scenario: Ms. Jones is a 5th grade physical education teacher. She is planning to cover the vertical jump component of the required physical fitness test in her class. Cindy Street is a 9 year old female student in the class and Ms. Jones tells Cindy to line up approximately 25 feet from the brick wall and run at it, stop and jump up to touch as high as she can on the wall with her right hand. Ms. Jones does not demonstrate the vertical jump. No padding is on the wall and Cindy is dressed in her school clothes which includes a sweatshirt, slacks, and sneakers. The floor is made of a slippery linoleum surface. When Cindy approaches the wall, she slips and crashes into the wall face first. She knocks out two front teeth and she is bleeding from her mouth. Ms. Jones does not have an emergency plan in place so she asks one of the students to go and find the school nurse while she places a wet cloth on Cindy’s mouth.
