Compliance driven by the government, ethics driven by the individual, yet both being necessary concepts in any successful organization.” (Schipske, 2016) It is necessary to have compliance in a healthcare setting because it ensures that every organization, no matter the specialty, is in accordance withal legal, ethical, and professional rules required. Allowing organizations to practice medicine as well as establish a program that prevents, detects, and resolves potential pitfalls and vulnerabilities. Essentially to minimize liabilities and potential penalties proper planning and education, focuses on the mission of high quality and patient-centered care. State and federal laws hold healthcare organizations to strict standards and if these are violated, lawsuits, fines or even the loss of licenses can be the result. Different federal and state agencies govern healthcare compliance. Therefore, there are many different aspects, and a lot of healthcare organizations have a difficult time keeping up with healthcare compliance because of the ever-changing laws and regulations. To follow these changes and enforce compliance, most organizations have a person, or a department dedicated to just that, creating, implementing, and enforcing compliance. However, this person or department is not the only person or persons that are responsible for compliance. Each staff member has a role in maintaining compliance. (2020). Patient privacy is one of the biggest issues in healthcare compliance. When it comes to ethics in healthcare, moral principles, beliefs, and values are what direct us to make choices about medical care. “At the core of health care ethics is our sense of right and wrong and our beliefs about rights we possess and duties we owe others.” (2019) the core principles of healthcare ethics are autonomy, beneficence, no maleficence, and justice. All these principles typically should be equally important but in the United States autonomy is usually considered top priority amongst patients. Patient autonomy can walk a thin line when it comes to ethics in healthcare. For example, a patient’s right to refuse treatment, medical aid in dying, and honoring do not spoon feed requests. The current top five ethical issues in healthcare are as follows: do not resuscitate orders, doctor and patient confidentiality, malpractice and negligence, access to care, and physician assisted suicide. A Do-Not-Resuscitate (DNR) is a written order by a doctor, by request of the patient, to not perform CPR if the patient were to stop breathing. Doctor and patient confidentiality requires the physician to keep the patient’s medical records private. “For example, withholding information about a patient’s condition could be unethical because it could harm the patient or someone else.”(Florida Tech) Malpractice and negligence are forms of medical errors. The third leading cause of deaths in the United States are medical errors. Since 2017, access to care has increased due to more people becoming medically insured. However, one in five patients remain uninsured and do not seek medical care due to costs. Physician-assisted suicide (PAS) is when someone with medical experience assists a patient with ending their life. PAS has always been debated as to whether the act is unethical or enabling a patient to practice autonomy. Some states even consider PAS to be illegal. (Florida Tech). Compliance issues can be addressed in different ways. Some of the top compliance concerns are hacking and malware, unsecured data, and improper records disposal.
